All Developers should make sure that as part of their due diligence before embarking upon a particular development that checks are made as to any potential Rights to Light issues that there may be and that any such issues are resolved before the work on the development commences. The Law Commission are currently carrying out a review on how Rights to Light issue are acquired and the remedies that are available to claimants claiming breach of such rights and once guidance is known following the completion of their review we will produce a bulletin.
